Terms of Service

Welcome to Láttam, Hallottam. These Terms of Service ("Terms") govern your access to and use of the Láttam, Hallottam mobile application and web platform (the "Service"), operated by Láttam, Hallottam Kft. ("we," "our," or "us").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Service.

1. Eligibility

To use our Service, you must:

Be at least 16 years of age
Have the legal capacity to enter into a binding agreement
Not be prohibited from using the Service under applicable law
Not have been previously banned from the Service

By creating an account, you represent and warrant that you meet all eligibility requirements.

2. Account Registration

2.1 Account Creation

To access certain features, you must create an account. When registering, you agree to provide accurate, current, and complete information and to update such information to keep it accurate.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

Create a strong, unique password
Not share your account credentials with others
Notify us immediately of any unauthorized access or security breach
Log out of your account when using shared devices

2.3 Account Types

We offer two types of accounts:

Individual Accounts - For personal use by community members
Business Accounts - For businesses and organizations to promote their services, post jobs, and engage with the community

3. Services We Provide

Láttam, Hallottam is a local community platform that enables users to:

Discover and create local events
Find and share deals and discounts
Buy and sell items in the marketplace
Report and search for missing pets
Post and find lost and found items
Browse local jobs and apply to positions
Join community clubs and participate in discussions
Read local news and restaurant information
Send messages to other users
Participate in polls and community activities
Earn XP and badges through community participation

4. User Content

4.1 Your Content

"User Content" means any content you create, upload, share, or submit through the Service, including text, photos, videos, comments, reviews, and other materials.

4.2 License Grant

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service and our business operations. This license continues even if you stop using our Service, but only for content that has been shared with others.

4.3 Your Responsibilities

You are solely responsible for your User Content. You represent and warrant that:

You own or have the necessary rights to share the content
Your content does not infringe any third party's intellectual property or other rights
Your content complies with these Terms and our Acceptable Use Policy
Your content is accurate and not misleading (especially for deals, events, and marketplace listings)

4.4 Content Removal

We reserve the right to remove or disable access to any User Content that violates these Terms or that we believe is harmful, without prior notice. We are not obligated to monitor all User Content but may do so at our discretion.

5. Marketplace Terms

5.1 Listings

When creating marketplace listings, you agree to:

Provide accurate descriptions and photos of items
Set fair and honest prices
Only list items you have the legal right to sell
Not list prohibited items (see Acceptable Use Policy)
Respond promptly to interested buyers

5.2 Transactions

Láttam, Hallottam facilitates connections between buyers and sellers but is not a party to any transaction. We do not:

Handle payments between users for marketplace items
Guarantee the quality, safety, or legality of listed items
Guarantee that transactions will be completed
Provide refunds for peer-to-peer transactions

Users are responsible for arranging payment, meeting safely, and completing transactions. We recommend meeting in public places and using secure payment methods.

5.3 Listing Expiration

Marketplace listings automatically expire after 30 days. You may renew listings before or after expiration.

6. Business Account Terms

6.1 Business Verification

Businesses may apply for verification to receive a verified badge. Verification requires providing valid business documentation, including tax identification numbers. We reserve the right to deny or revoke verification at our discretion.

6.2 Business Content

Businesses agree that all posted content (events, deals, jobs, etc.):

Is accurate and not misleading
Complies with applicable consumer protection and advertising laws
Includes clear terms for any deals or promotions
Does not contain false or deceptive claims

6.3 Staff Accounts

Business accounts may invite staff members with assigned roles. The primary account holder is responsible for all activity by staff members.

7. Payments and Subscriptions

7.1 Free and Paid Features

Our Service includes both free features and paid subscriptions/purchases. Free features may be limited compared to paid tiers.

7.2 Subscription Plans

We offer the following subscription plans:

Community Premium (D2C) - For individual users seeking enhanced features
Business Starter - Basic business features with limited posts
Business Pro - Unlimited posts with advanced analytics and features
Business Enterprise - Full feature access with dedicated support

Current pricing is available at our pricing page. Prices are in Euros (EUR) and include applicable taxes.

7.3 Billing

Subscriptions are billed monthly in advance
Payment is processed through Stripe
Subscriptions automatically renew unless canceled
You may cancel at any time; access continues until the end of the billing period
No refunds for partial billing periods

7.4 Coins and Credits

Users may purchase "Coins" for use within the Service (e.g., promoting content). Coins are non-refundable and have no cash value. Unused coins may expire as specified at time of purchase.

7.5 Price Changes

We may change our prices with 30 days' notice. Price changes take effect at your next renewal.

8. Intellectual Property

8.1 Our Intellectual Property

The Service, including its design, features, and content (excluding User Content), is owned by Láttam, Hallottam and protected by copyright, trademark, and other intellectual property laws. You may not:

Copy, modify, or distribute our Service or content
Reverse engineer or decompile the Service
Use our trademarks without permission
Create derivative works based on our Service

8.2 Feedback

If you provide feedback or suggestions about our Service, you grant us the right to use that feedback without compensation or attribution.

9. Prohibited Conduct

You agree not to:

Violate any applicable law or regulation
Infringe any third party's rights
Post false, misleading, or fraudulent content
Harass, threaten, or abuse other users
Create multiple accounts to evade restrictions
Use automated tools to access or scrape the Service
Interfere with the Service's operation or security
Attempt to gain unauthorized access to any system
Use the Service for spam or unsolicited communications
Impersonate others or misrepresent your affiliation

10. Third-Party Services

Our Service integrates with third-party services including Stripe (payments), Google Maps (location services), and OpenAI (AI features). Your use of these features is also subject to the respective third parties' terms and privacy policies.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The Service will be uninterrupted, secure, or error-free
User Content is accurate, reliable, or trustworthy
Transactions between users will be completed satisfactorily
Missing pets or lost items will be found
Business information or deals are accurate or available

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LÁTTAM, HALLOTTAM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM:

Your use of or inability to use the Service
Any conduct or content of third parties on the Service
Transactions between users
Unauthorized access to your account or data

Our total liability for any claims arising from your use of the Service shall not exceed the amounts you paid to us in the twelve (12) months preceding the claim, or €100, whichever is greater.

These limitations apply regardless of the legal theory and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Láttam, Hallottam and its affiliates from any claims, damages, losses, and expenses (including legal fees) arising from:

Your violation of these Terms
Your User Content
Your violation of any third party's rights
Your use of the Service

14. Termination

14.1 Termination by You

You may delete your account at any time through the app settings. Upon deletion:

Your profile and personal data will be deleted within 30 days
Your public content may remain visible (attributed to "Deleted User")
Active subscriptions will not be refunded
Unused coins will be forfeited

14.2 Termination by Us

We may suspend or terminate your account at any time, with or without cause, with or without notice. Reasons for termination may include:

Violation of these Terms or our policies
Illegal or fraudulent activity
Requests from law enforcement
Extended periods of inactivity
Discontinuation of the Service

14.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. Sections that by their nature should survive will survive termination, including ownership, disclaimers, indemnification, and limitations of liability.

15. Dispute Resolution

15.1 Informal Resolution

Before filing any legal claim, you agree to contact us at legal@lattamhallottam.hu and attempt to resolve the dispute informally for at least 30 days.

15.2 Governing Law

These Terms are governed by and construed in accordance with the laws of Hungary, without regard to conflict of law principles.

15.3 Jurisdiction

Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the courts of Budapest, Hungary. You consent to the personal jurisdiction of such courts.

15.4 Consumer Rights

If you are a consumer in the European Union, you may also bring proceedings in the courts of your country of residence, and mandatory consumer protection laws of your country apply.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Láttam, Hallottam regarding the Service.

16.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights without restriction.

16.5 Modifications

We may modify these Terms at any time. We will provide notice of material changes via email or in-app notification at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
